TERMS AND CONDITIONS – SOCIAL MEDIA GIVEAWAY
These terms and conditions apply to the giveaway hosted on Instagram (the “Giveaway”) by Atomi Shine, operated by ATOMI SHINE LIMITED, located at Room A5,7/F,Astoria Building,No.34 Ashley Road,Tsim Sha Tsui,Kowloon,Hong Kong (“Atomi Shine”, “we”, “us”, or “our”).
These terms, together with the information provided in the Instagram post announcing the Giveaway and our applicable privacy notice, constitute the full and final agreement governing the Giveaway (the “Contract”). Please read the Instagram post, these Terms and Conditions, and the privacy notice carefully before participating. By entering the Giveaway, you (“the participant”, “you”, or “your”) acknowledge and accept the Contract in full.
Participation in the Giveaway is free of charge and does not require any purchase of products or services.
The Giveaway is solely organized by Atomi Shine and is in no way sponsored, endorsed, administered by, or associated with Instagram.
1. PARTICIPATION ELIGIBILITY
To participate in the Giveaway, you must:
a) be at least 18 years of age,
b) reside in any country or region where participation in such giveaways is legally permitted,
c) not be an employee of Atomi Shine, nor an immediate family member of an employee.
By entering the Giveaway, you confirm and warrant that you meet all eligibility requirements stated above. Should it come to Atomi Shine’s attention that you have participated without fulfilling these conditions, Atomi Shine reserves the right to disqualify you from the Giveaway, and you will not be eligible to be selected as the winner.
2. GIVEAWAY TERM AND DRAWING THE WINNER
The detailed participation requirements for the Giveaway will be stated in the Instagram post published on Atomi Shine’s official account, @atomishineofficial, at the start of the Giveaway. Once you have completed all requirements described in that post, you will be eligible for the random draw to select the winner.
The winner will be chosen at random from all eligible participants and will be announced in accordance with the instructions provided in the Giveaway post.
The start and end dates of the Giveaway will be specified in the Giveaway post on Atomi Shine’s Instagram account. The winner will be selected and announced on the same account, following the timeline communicated in the post.
Please note that the winner will only be contacted via direct message from Atomi Shine’s verified official Instagram account. We will never ask you to follow additional accounts, provide payment information, or make any form of transfer.
3. PRIZE
The giveaway prize will be an Atomi Shine product, as stated in the announcement post. The prize will be shipped to the winner, and Atomi Shine will cover all shipping costs. The prize cannot be exchanged, refunded, or redeemed for cash.
Please note that the winner may be responsible for any applicable taxes or duties in accordance with local laws and regulations.
4. LIABILITY AND WAIVER
Atomi Shine can only be held liable for damages in cases of intentional misconduct or gross negligence, or where liability is otherwise imposed under applicable mandatory law. To the extent permitted by law, Atomi Shine’s liability shall be limited to the value of the prize in the Giveaway.
Atomi Shine makes no warranties, whether express, implied, or statutory, except as explicitly stated in this Contract. Participation in the Giveaway may be affected by circumstances beyond Atomi Shine’s control, including the actions of third parties such as the social media platform (Instagram), its availability, downtime, data loss, or technical malfunctions. Atomi Shine shall not be liable for any errors, delays, damages, or other consequences resulting from such circumstances.
5. PRIVACY / PERSONAL DATA
Your privacy and the protection of your personal information are important to us. For this reason, please read our Privacy Notice for further details on how and why Atomi Shine will process your personal data in connection with the Giveaway.
6. ADVERTISING CONSENT
By participating in the Giveaway, you acknowledge and agree that, if you are selected as the winner, your name may be published on Atomi Shine’s social media accounts. You consent to this use of your name. You may withdraw your consent at any time by contacting us at support@aotmishine.com .
7. LEGALITY AND GOVERNING LAW
The Giveaway and this Contract are governed by the laws of Hong Kong. Any disputes arising from or in connection with the Giveaway, the Contract, or its terms shall be exclusively resolved by the courts of Hong Kong.
If any provision of this Contract, or part thereof, is found to be invalid or unenforceable by a competent authority, this shall not affect the remaining provisions, unless the obligations of you or Atomi Shine would become unreasonably burdensome without the invalid provision.
